"Salvemos Mojácar" recurre ante el TSJA el PGOU de Carboneras (Almería)
"Save Mojácar" TSJA used against the General Plan of Carboneras (Almería)
Almería, Jan 3 (EFE) .- The platform “Save Mojácar” has filed with the Superior Court of Justice of Andalusia (TSJA) a lawsuit against the General Urban Plan (Plan) of the City of Carboneras (Almería), which maintains as buildable the site of the locust, in the Parque Natural de Cabo de Gata.
In its application, “Save Mojácar” City Council accused of “abuse of power” by not adapting to the General Plan Plan Natural Resources Management (PORN) Natural Park Cabo de Gata-Nijar and for breaking the Law of Urban Planning of Andalusia (LOUA) and other regional standards, national and European.
In addition, accuses the Government of Andalusia of “collusion” and “lying to the public” to “do everything possible” to legalize the resort of the carob tree, whose launch was halted by court order in February 2006.
"Save Mojácar, which joins the demand made by Ecologists in Action and Greenpeace, recalled that a total of twelve sentences have declared the land areas of the Algarrobo (ST1 and ST2) and protected land.
The TSJA ordered the November 25, 2008 partial paralysis PORN Natural Park Cabo de Gata-Nijar finding that could lead to the implementation of the hotel, a complex of twenty storeys and 411 rooms.
On May 5 issued an order forbidding the mayor of Carboneras, Cristóbal Fernández (PSOE), “take any action planning” in the field of the carob tree, “with the warning from engaging in criminal contempt,” after the City Council approved in August 2009 planning rules that label the area as developable.
The Andalucian High Court recently dismissed the application for reconsideration filed by the municipality of Carboneras against this decision, so that the prohibition of “any urban development” in the area is firm.
However, “Save Mojácar” is “intolerable and scandalous” that the mayor “continues to ignore the law” as “any rule of law had been disabled long ago.”
Depending on the platform, the fact that Fernandez remain in office “demonstrates not only the absolute inability and unwillingness of the PSOE to act in accordance with the principles of democracy in urban issues, but the complex web of corruption related to Algarrobico potentially affecting all kinds of objections of the PSOE and the PP in the municipal, regional and state. “ EFERead more at www.efeverde.es
